Terms of Service

These Terms of Service (“Terms”) govern your use of the Instamaker website and services, available at instamaker.ai (the “Service”), operated by NOW_JSS4S PTE. LTD., a company registered in Singapore (UEN 202420668K), whose registered office is at 100D Pasir Panjang Road, #05-03 Meissa, Singapore 118520. Instamaker is the name of the product. By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Using the Service

You may use the Service only if you are at least 13 years old (or the age of majority in your country) and in compliance with these Terms. You are responsible for keeping your account credentials safe, and for everything that happens under your account. We may refuse service, suspend accounts, or change features at any time.

The Service is not currently offered to anyone located in the European Union, the European Economic Area or the United Kingdom. By using it, you confirm you are not located there.

2. AI-generated content

The Service generates content using artificial intelligence. AI can make mistakes — output is not guaranteed correct or safe. You are responsible for reviewing anything you generate and for what you choose to publish. Never assume generated content is factually accurate, original, or safe to post.

3. Your content and your responsibility

We are not responsible for any personal or vulnerable/sensitive information users share on the website. Do not include personal data, secrets, or sensitive information in your profile descriptions, prompts, or uploaded designs. You keep ownership of the content you upload, and you are responsible for making sure you have the right to use it.

4. Third-party services

The Service relies on third-party providers to function. The LLM provider is of our choice and we are not responsible for their actions. Images may be served by Unsplash, a third-party image provider; their availability, terms, and licenses apply to the images they supply. These third parties have their own terms and privacy policies, which you should review.

5. Billing and payments

Paid plans are billed on a recurring basis through Stripe, a third-party payment processor. Stripe handles your payment details; we do not store your card numbers. Subscriptions continue until you cancel them, and cancelling stops the next renewal — you keep access until the end of the period you have already paid for.

Outside the right of withdrawal described in section 6, and outside any refund we agree to give you at our discretion, payments for periods that have already begun are not refunded. Nothing in these Terms limits any right you have under the consumer law of the country you live in.

Our refund, cancellation and dispute policy is set out on the Refunds, cancellation and disputes page, which forms part of these Terms.

6. Right of withdrawal

Not applicable while the Service is not offered in the EU, EEA or UK. Outside those regions, you may have rights under the consumer law of your country; nothing in these Terms limits them.

7. No warranty

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose. We do not guarantee that the Service will be uninterrupted, error-free, or that generated content will meet your expectations.

8. Termination

You may stop using the Service at any time and delete your account. We may suspend or terminate your access if you violate these Terms or misuse the Service. Sections that should survive termination — including warranty disclaimers and liability limits — will survive it.

9. Export and sanctions restrictions

You may not use the Service where doing so is prohibited by the export control or sanctions laws that apply to it, including those of Singapore, the United Nations, the United States (the sanctions administered by OFAC and the Export Administration Regulations) and the European Union, or if you are a person who is subject to such sanctions. You may not use, resell or make the Service available in or to a sanctioned jurisdiction or person; attempts to circumvent these restrictions are a breach of these Terms.

10. Promotions

No promotions are currently offered. If we offer a promotion, it states its own terms together with the offer, and these Terms also apply to it.

11. Governing law

These Terms are governed by the laws of Singapore, and the courts of Singapore have non-exclusive jurisdiction over disputes arising from them. If you are a consumer, you may also bring proceedings in the courts of the country where you live. This does not remove the mandatory consumer protections of the country you live in.

12. Changes to these Terms

We may update these Terms from time to time. The latest version will always be available at this page and the Refunds page, which forms part of these Terms. Continued use of the Service after changes take effect means you accept the updated Terms.
